Who can use this

This Agreement is for anyone who wants to create an affiliate structure. This Agreement is used between two parties (individual or company) to summarize an affiliate structure where Person A becomes an affiliate to Person B in return for an Affiliate commission payment. This can be a percentage of sales, a set dollar amount, or another form of compensation. The Affiliate (Person A) is engaged to provide online or in-person publicity or exposure to Person B’s products and services to a third person or company.

Example: Person A has affiliate links on his website that directly link back to Person B’s products. When a customer clicks on the link and buys from Person B, then Person A gets a commission payment from that sale.

The Affiliate Agreement is different from a Joint Venture/Partnership Agreement because an Affiliate doesn’t own a portion of the Company or isn’t creating an equal partnership. The Affiliate is just providing exposure for the Company’s products and services in return for a commission or payment. In contrast, a partner will have more responsibilities and obligations in the partnership.

The Affiliate Agreement is also different from a Brand Ambassador Agreement because a Brand Ambassador may be exclusive. An Affiliate Agreement may or may not be exclusive, but the Affiliate doesn’t usually provide publicity the way a Brand Ambassador may provide publicity for a commission payment.

The Affiliate Agreement is different from a Referral Agreement because a Referral may be exclusive; an Affiliate may or may not be exclusive. Usually, an Affiliate provides links directly to the Company’s products or services for payment. A Referring Party may provide a direct, personal introduction or contact to the Company to obtain the referral fees.

An AFFILIATE AGREEMENT is an Agreement that Person A becomes an affiliate to Person B in return for an Affiliate commission payment. This is a FULL agreement that protects the Company engaging the Affiliate ONLY.
